Waiver and Release of Liability And Photo Release

I am voluntarily participating in the CanopyBloomington activity (“Activity”) and I am participating in the Activity entirely at my own risk. I am aware of the risks associated with traveling to and from as well as participating in the Activity, which may include, but are not limited to, physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and death. I understand that these injuries or outcomes may arise from my own or others’ negligence, conditions related to travel, medical conditions known or unknown, or the condition of the Activity location(s). Nonetheless, I assume all related risks, both known or unknown to me, of my participation in the Activity, including travel to, from and during the Activity.

Liability Release/Waiver: Acknowledging that such risks exist, I hereby RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE CanopyBloomington and its officers, directors, employees, volunteers, representatives, and agents, from and against any and all claims, damages, injuries, losses, actions, suits, proceedings, expenses, and attorney fees that I, or anyone on my behalf have or might have for any death, injury, damage or claimed injury or damage arising out of, involving or relating to my participation in the Activity. This release includes any claims that the act or omission complained of was caused in whole or in part by the strict liability or negligence in any form of the Released Parties.

Indemnification: I further agree to indemnify and hold harmless CanopyBloomington and its directors, officers, volunteers, employees, representatives and agents, against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney’s fees and any related costs, as a result of my participation in the Activity and/or for my failure to comply with the terms of this agreement. This agreement to indemnify, hold harmless and defend applies even if the act or omission complained of was allegedly caused in whole or in part by the strict liability or negligence in any form of the Released Parties.

I also hereby grant CanopyBloomington permission to use my likeness in a photograph, video, or other digital media (“photo”) in any and all of its publications, including web-based publications, without payment or other consideration. I understand and agree that all photos will become the property of CanopyBloomington and will not be returned. I hereby irrevocably authorize CanopyBloomington to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my likeness appears.

I HAVE READ AND UNDERSTAND THE ABOVE WAIVER AND RELEASE OF LIABILITY, AND PHOTO RELEASE. I AFFIRM THAT I AM AT LEAST 18 YEARS OF AGE, OR, IF I AM UNDER 18 YEARS OF AGE, I HAVE OBTAINED THE REQUIRED CONSENT OF MY PARENTS/GUARDIANS AS EVIDENCED BY THEIR SIGNATURES BELOW.
